Terms and Conditions
The following terms and conditions (“Conditions”) apply to the Trimble Viewpoint Spectrum User Summit and Trimble Viewpoint Vista User Summit (each the “Conference”) hosted by Viewpoint, Inc., a Trimble affiliate (“Trimble Viewpoint”). By registering for a Conference, you accept these Conditions, which shall govern your attendance at and participation in the Conference.
Registration and Admission
Trimble Viewpoint reserves the right to accept or decline any registration to attend the Conference.
Attendees are expected to be respectful to other attendees, Trimble Viewpoint staff members, exhibitors, and vendors. Harassment and other misconduct will not be tolerated; violations will be addressed promptly. Trimble Viewpoint reserves the right to prohibit participation or to revoke any individual’s access to the Conference, whether an attendee, exhibitor, or vendor, whose conduct is not in keeping with the character and purpose of the Conference or whose conduct is otherwise objectionable, disorderly, disruptive, or in violation of any laws as determined by Trimble Viewpoint in its sole and complete discretion.
Virtual Conference Platform
As part of your participation in the virtual Conference, you may choose to participate in activities that will result in sharing your personal information and other information about your participation in the Conference with other attendees, Trimble Viewpoint staff members, exhibitors, vendors, and partners. Such information may include content you share while using chat functionality, your status on leaderboards, your participation status, your activity history, and information you share through your profile page. Trimble Viewpoint may also monitor and track your activity and participation in the virtual Conference platform in connection with its administration and management of the Conference.
Privacy and Use of Your Personal Information
Trimble Viewpoint may use your personal information to contact you about the Conference and send you marketing emails related to Trimble Viewpoint publications, products, and services. You may opt out of receiving emails by clicking on the opt-out/unsubscribe link located at the bottom of any of the emails and following the instructions.

Trimble Viewpoint uses a third party vendor, Bizzabo, to support Conference registration and deliver the virtual Conference platform. Bizzabo’s privacy policy can be found at https://www.bizzabo.com/privacy.
Appearance Release
By registering for and participating in the Conference, you grant permission to Trimble Viewpoint and its contractors to record, photograph, or otherwise capture your likeness, appearance, and name, and to edit, copy, distribute, display, publish, make derivatives of, and otherwise use such materials, in whole or in part, for any purpose, including but not limited to marketing and promotional purposes. You understand that Trimble Viewpoint will be the sole owner of the results and proceeds of these recordings, images, and materials. You waive any right to inspect or approve the use of such materials or of any written copy related to such materials. You also waive any right to royalties or other compensation arising from or related to the use of such materials. By registering for and participating in the Conference, you agree to release, defend, indemnify, and hold harmless Trimble Viewpoint from and against any claims, damages, or liability of any kind or nature arising from or related to the use of these recordings, images, and materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity.
Cancellation Policy
Trimble Viewpoint reserves the right to cancel or reschedule the Conference at any time. If Trimble Viewpoint determines that it must cancel the Conference, Trimble Viewpoint will promptly notify you. You are solely responsible for any incurred costs, expenses, and/or fees related to the canceled or rescheduled Conference.
Unauthorized Commercial Solicitation
Unauthorized commercial solicitation at the Conference is prohibited. Any non-exhibiting supplier, vendor, or attendee observed distributing information or soliciting business at the Conference will be asked to exit the virtual Conference.
Indemnification of Trimble Viewpoint; Limitation of Liability; Release of Claims
As a condition of your participation in the Conference, you agree to indemnify and hold harmless Trimble Viewpoint and its parent company, affiliates, subsidiaries, and its and their contractors, officers, employees, agents, directors, and shareholders from and against any and all claims and liabilities of whatever kind or nature in law, equity, or otherwise, arising from your actions, omissions, fault, or negligence, which result in damage to Trimble Viewpoint or to any third party, including personal injury to or death of any person and/or damage to or loss of use of property.
IN NO EVENT WILL TRIMBLE VIEWPOINT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING FROM YOUR PARTICIPATION IN THE CONFERENCE, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF TRIMBLE VIEWPOINT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. TRIMBLE VIEWPOINT’S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ACTUAL DAMAGES FROM ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE), SHALL BE LIMITED TO $500 USD.
As a condition of your participation in the Conference, you agree to fully, finally, and forever release, waive, discharge, and covenant not to sue, demand, claim, or proceed to collect from Trimble Viewpoint and its parent companies, affiliates, subsidiaries, and its and their contractors, officers, employees, agents, directors, and shareholders, any and all present and future claims, demands, actions, attorney’s fees, causes of action, suits, damages, losses, and expenses, of any kind or nature, whether known or unknown, arising from or relating to your participation in the Conference.
General
If a court finds any provision of these Conditions unenforceable as written, then the court shall interpret, modify, or strike all or a portion of that provision so as to effect as much of the parties’ agreement and intent as is legally possible. Regardless of the enforceability of any particular provision, the other portions of these Conditions shall continue in full force and effect. Those provisions of these Conditions that by their nature are intended to survive termination or expiration of the Conditions shall so survive. These Conditions are governed by and will be construed in accordance with the laws of the State of Oregon without regard to its conflict of law principles. You expressly consent to the personal jurisdiction and venue of the state and federal courts located in Multnomah County, Oregon.
Trimble Viewpoint Virtual Events Code of Conduct
You’re invited to come as you are, and engage with us in a way that’s meaningful and applicable to your own personal perspective. As such, we are committed to creating events that are diverse, inclusive, safe, and free from discrimination, regardless of race, religion, color, national origin, sex, sexual orientation, gender expression or identity, transgender status, age, disability, veteran, or marital status, or any other classification protected by law.
All participants of Trimble Viewpoint events must abide by the following policy:
Expected Behavior for All Attendees
- Be considerate, respectful, and collaborative.
- Refrain from demeaning, discriminatory, or harassing behavior and speech (both verbal and written).
- Alert event organizers if you notice any behavior that is not aligned with this code of conduct by emailing events@viewpoint.com
Unacceptable Behavior for All Attendees
Unacceptable behaviors for any attendee may include but are not limited to:
- Harassment and discrimination includes any verbal, physical, or visual conduct based on race, religion, color, national origin, sex, sexual orientation, gender expression or identity, transgender status, age, disability, veteran, or marital status, or any other classification protected by law.
- Inappropriate use of nudity and/or sexual images; deliberate intimidation, stalking, or following; harassing, photography, or recording; sustained disruption of sessions, talks, or other events; inappropriate physical contact; and any unwelcome sexual attention.
- Any boisterous, lewd, or offensive behavior or language, using sexually explicit or offensive language or conduct, profanity, obscene gestures, or racial, religious, or ethnic slurs.
- Wearing clothing in video or photos that is not suitable for a professional work environment, that is provocative, inappropriate, or otherwise potentially offensive.
- Possession of a weapon or any item that can be used as a weapon in your photos or video.
- Being intoxicated, as determined by Viewpoint, in any event site or function. Please drink responsibly.
- Showcasing or promoting any illegal substance in conversation, chat, photo, video, or text.
- Assembling for the purpose of, or resulting in, disturbing the peace, or committing any unlawful act or engaging in any offensive behavior.
- Any other illegal activity not already covered above.
- Failure to obey any of the rules or regulations of the event or instructions of the event staff.
- Sharing your event login credentials with other individuals.
Consequences of Unacceptable Behavior
Unacceptable behavior will not be tolerated. Anyone asked to stop unacceptable behavior is expected to comply immediately. If a participant engages in unacceptable behavior, the event organizers may take any action they deem appropriate, up to and including expulsion from the event without warning or refund and, if appropriate, involvement of local law enforcement. Breaches of this Code of Conduct can also result in disqualification from participating in future events.

If you experience or witness a life safety emergency, please contact your local authorities. In North America dial 911, immediately.
If you have a complaint or concern about harassment, discrimination, bullying, or any other conduct that violates this Code of Conduct, we encourage you to contact us immediately. If you witness this happening to someone else, please report that, too. You may request that your report remain confidential.

The Code of Conduct may be revised at any time by Trimble Viewpoint and the terms are non-negotiable. This Code of Conduct is without prejudice to Trimble Viewpoint’s rights, all of which it expressly reserves.
Together, we can ensure Trimble Viewpoint events are safe and welcoming experiences.
